  1. Acceptance of Terms

By requesting and utilizing the towing and roadside assistance services provided by All State Towing LLC (“All State Towing,” “we,” “our,” or “us”), you (“Customer,” “you,” or “your”) agree to be bound by these Terms and Conditions. These terms apply to all services rendered by All State Towing. If you do not agree to these terms, you must not engage our services.

  1. Services Provided

All State Towing LLC offers towing, recovery, and roadside assistance services. Services are provided upon request and availability. We strive to provide prompt and professional service, but we do not guarantee specific times of arrival due to factors such as traffic, weather, and service call volume.

  1. Customer Responsibilities
  • Accurate Information: You agree to provide accurate and complete information regarding your location, vehicle details, and the nature of the service required.
  • Vehicle Condition: You represent and guarantee that the vehicle to be towed is safe to tow and does not contain any hazardous materials or illegal substances. You are responsible for any damage caused to our equipment due to misrepresentation of the vehicle’s condition.
  • Payment: You agree to pay all fees associated with the services rendered. Payment is due upon completion of services unless otherwise agreed upon in writing.
  • Authorization: You confirm that you are the owner of the vehicle or have legal authorization to request towing services for the vehicle.
  1. Fees and Payment
  • Service Fees: Fees for towing and roadside assistance are based on factors such as distance, vehicle type, time of day, and complexity of the service. A price estimate will be provided at the time of service request; however, final charges may vary based on actual service requirements.
  • Additional Charges: Additional charges may apply for services such as winching, complex recovery, off-road recovery, long-distance towing, or storage.
  • Payment Methods: We accept cash and major credit cards.
  • Late Payment: Overdue payments may be subject to late fees and interest. All State Towing LLC reserves the right to place a lien on the towed vehicle for unpaid services in accordance with applicable law.
  1. Vehicle Storage
  • If a vehicle requires storage, it will be stored at our designated impound lot or an authorized facility.
  • Storage fees will be charged daily and are in addition to towing and service fees.
  • All State Towing LLC is not responsible for any damage to the vehicle while in storage.
  • You are responsible for retrieving your vehicle and settling all outstanding charges.
  • Failure to retrieve your vehicle may result in the vehicle being disposed of in accordance with applicable laws.
  1. Liability Limitations
  • Care in Towing: All State Towing LLC will exercise reasonable care in performing its services. However, we shall not be liable for:
    • Pre-existing damage to the vehicle.
    • Mechanical failure of the vehicle during towing (e.g., transmission, drivetrain issues).
    • Damage to the vehicle’s undercarriage, exhaust system, or other components not directly impacted by the towing process.
    • Damage to personal property inside or attached to the vehicle.
    • Acts of God, weather, or other unforeseen circumstances beyond our control.
  • Maximum Liability: Our maximum liability for any damage to the vehicle during towing shall be limited to the reasonable cost of repair for the specific damage directly caused by our negligence. Proof of damage and repair estimates from qualified repair shops will be required.
  • No Warranty: All State Towing LLC provides no warranty, express or implied, regarding the condition of the vehicle after towing or the success of any repair or roadside assistance.
  1. Indemnification

You agree to indemnify, defend, and hold harmless All State Towing LLC, its owners, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys’ fees) arising from your use of our services, your breach of these Terms, or any misrepresentation on your part.

  1. Prohibited Conduct

You agree not to:

  • Obstruct or interfere with our services.
  • Engage in any illegal activities in connection with our services.
  • Provide false information to our staff.
  • Tamper with our equipment or vehicles.
  1. Cancellations and Refunds
  • If you cancel a service request before our truck is dispatched, no fee will be charged.
  • If our truck has been dispatched, a cancellation fee may apply to cover costs incurred.
  • Refunds for services rendered will be considered on a case-by-case basis and are not guaranteed. All disputes regarding fees must be reported before our service completion.
  1. Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of Nevada, without regard to its conflict of law principles.
